Terms and Conditions for Tamo AI
 

  1. General Provisions

     

    1.1 Scope

    These terms and conditions (“T&Cs”) apply to all contracts between Tamo AI and the user regarding the provision and use of the LinkedIn automation tool Tamo AI. By registering, the user agrees to these T&Cs.

    1.2 Subject Matter of the Contract

    Tamo AI offers an API-based automation platform that enables the sending of automated messages and connection requests to LinkedIn contacts. The exact functionality depends on the subscription plan selected by the user.

    1.3 Changes to the T&Cs

    Tamo AI reserves the right to change these T&Cs at any time. Users will be notified of changes in a timely manner. If the user does not object within 14 days, the changes are deemed accepted.


     

  2. User Rights and Obligations

    2.1 Permitted Use
    The user agrees to use Tamo AI only in accordance with LinkedIn’s terms of use. The service may only be used for lawful purposes. Any abusive or illegal use is prohibited.
    2.2 Account Security
    The user is responsible for the security of their account and login details. All activities conducted through the user’s account are the user’s responsibility.
    2.3 Compliance with LinkedIn Policies
    The user is obligated to comply with LinkedIn’s usage policies. Tamo AI assumes no liability for non-compliance with LinkedIn’s policies by the user, particularly not for account suspensions.
    2.4 Prohibited Activities
    The use of Tamo AI for sending unsolicited messages (spam) or for illegal purposes is strictly prohibited. Tamo AI reserves the right to suspend or delete accounts in case of abuse without prior notice.

     

  3. Tamo AI Services

    3.1 Service Scope
    Tamo AI offers various subscription plans, which are described on the website. The functionality depends on the chosen plan.
    3.2 Availability
    Tamo AI strives for high availability but cannot guarantee constant availability. Maintenance work or technical problems may cause temporary outages.
    3.3 Service Modifications
    Tamo AI reserves the right to modify, expand, or discontinue the service at any time to meet changing requirements or legal frameworks, as far as legally permissible.

     

  4. Payment Terms and Subscriptions

    4.1 Subscriptions
    The exact terms and prices of the subscriptions are available on Tamo AI’s website. Users can choose between monthly or yearly subscriptions.
    4.2 Payment Terms
    Payment is made in advance for the respective billing period. The prices indicated are exclusive of any applicable taxes unless stated otherwise.
    4.3 Automatic Renewal
    Subscriptions automatically renew unless canceled before the end of the current billing period in accordance with Section 5 of these T&Cs. Refunds for already paid subscription periods are excluded unless the reason for cancellation lies within Tamo AI’s control.
    4.4 Refunds
    Amounts already paid will not be refunded unless expressly required by law.

     

  5. Termination and Suspension

    5.1 Termination by the User
    The user can terminate their subscription at any time through their Tamo AI account. Termination becomes effective at the end of the current billing period.
    5.2 Suspension by Tamo AI
    Tamo AI reserves the right to suspend accounts in case of abuse or violation of the T&Cs. In such cases, no refund will be issued for payments already made.
    5.3 Account Deletion
    Upon termination of the contractual relationship, the user’s account will be deleted unless legal retention requirements apply.

     

  6. Disclaimer and Limitation of Liability

    6.1 Liability for Content
    The user is solely responsible for the content sent via Tamo AI. Tamo AI assumes no liability for the content of messages sent by the user.
    6.2 Disclaimer for LinkedIn Account Suspensions
    Tamo AI is not liable for the suspension or restriction of the user’s LinkedIn account by LinkedIn. The user is responsible for ensuring their use of LinkedIn complies with its usage policies.
    6.3 Limitation of Liability
    Tamo AI is only liable for damages caused by intentional or grossly negligent behavior. Liability for slight negligence is excluded unless it involves the violation of essential contractual obligations.
    6.4 Force Majeure
    Tamo AI is not liable for delays or performance failures caused by circumstances outside Tamo AI’s control (e.g., natural disasters, government actions, force majeure).

     

  7. Data Protection

    7.1 Data Protection Policies
    Tamo AI processes personal data in accordance with applicable data protection laws. Further information can be found in the privacy policy on Tamo AI’s website.
    7.2 User Responsibility
    The user is responsible for complying with data protection regulations, particularly when sending messages via LinkedIn.

     

  8. Final Provisions

    8.1 Applicable Law
    All legal relationships between the user and Tamo AI are governed by the law of the country where Tamo AI is based, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
    8.2 Jurisdiction
    The exclusive place of jurisdiction for disputes arising from or in connection with these T&Cs is the competent court at the location of Tamo AI’s registered office.
    8.3 Severability Clause
    Should any provision of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
